Financial Statement 2 years after BR

Hi everyone

Long time no speak but I am in need of your good advice once again please.

I was declared BR over 2 years ago been discharged just over 1 year.

At the time of BR I had a car on hp that went into the BR. For some time after the BR order the HP co failed to acknowledge the BR and I ended up chasing them to recover the vehicle. They were also sending me default statements.

After about 8 months that all cleared up apart from I received an annual financial statement from them. I queried this, they apologised and confirmed they would update their records. This statement said I had an outstanding balance.

Having not heard anything since and also receiving confirmation from them that they had updated my credit file after I did the clean up I assumed all was well.

Today I've received another annual financial statement confirming there is an outstanding balance.

I am going to contact them again but considering the hassle I've had with these guys updating my details and their records I really want to get it sorted out once and for all.

Apart from contacting the OR is there any mileage in logging a complaint with FOS and ICO? Or would this be a pointless exercise?

    Have you checked your credit file with all three agencies, since they updated the account ? If its showing as closed and no balance i'd be tempted to simply ignore it.

    If you wanted to complain I would complain to company in writing once more, before going to FOS or ICO

    I kept getting annual statements from Halifax credit card for years after BR, I called they said they had to send them. Once I'd completed file clean up they stopped. I learnt later they they shouldn't have been sent. The advisors I spoke to were giving the wrong information.

    I think they are obliged to send at least annual statements, while the account is open. These statements should not be requesting or demanding repayment. It may be different in bankruptcy vs IVA

    Once the account is closed these statements should stop, in an IVA this would be once IVA has concluded, but in bankruptcy I'd expect it to be done by discharge
