Mil collections defence

Hi, I am new to the forum. I am another unfortunate recipient of a County Court Business Centre Claim Form from Mil Collections Ltd. This is for a Capital2Coast Fixed Charge Notice from mid 2014, which I contested at the time due to a faulty machine.

I just ignored the subsequent threatening letters from DRP and they stopped after a while.

This year I've had a threat of court action from Gladstones and then letters from Mil stating they had bought the debt, both of which I ignored following advice from my local CAB.

I've already done my acknowledgement leaving the defence box blank, but am having a bit of a hard time writing out my defence. I've read through lots of other people's on the forums, but am a bit confused whether to write out a blow-by-blow account of the harassment, or copy a really technical defence (which I don't really understand) like:

My mitigating circumstances were that the machine rejected one of my coins as it was printing the ticket, so I popped it back in and printed another ticket and put both in the windscreen (totalling the correct amount, but the expiry times were wrong). I have the photos that the car park attendant took of the tickets in the car (both clearly legible) and the car park signs as they were on the day .

Unfortunately I admitted I was driving when I originally wrote in and complained.

    Forget what happened on the day as you are no longer contesting the parking charge with C2C. You are now defending a case of an alleged debt which has been purchased by MIL. They are not chasing you for the parking charge per se.

    I'm no expert on this side of the house, but I do know you need to be challenging the legality of the assignment of the debt.

    Try reading threads on PePiPoo where the majority of these MIL cases have been dealt with over the past 6 months or more. You could also post a thread there too for additional support. You'll need an email address to register, but a hotmail one won't work.

  • Furthermore, C2C have breached the Data Protection Act in passing your details to MIL. There is scope to issue a claim against C2C for that breach - £750 seems the going rate. Check the Parking Prankster's blog on this.

    The various MIL threads will have references to this, as well as the fact that the debt has not been properly assigned from C2C to MIL.

Unfortunately I didn't keep the envelopes the letters from One Parking and the following one from Mil arrived in, but looking at them side by side it's pretty obvious they've come from the same printers. My address has an identical bar code over it and there are both have the same odd looking lines in the left margin.

    They made the fonts different though!

    Doesn't matter, because the point it they are not signed by an actual identifiable person, and are therefore merely just so much ink on some paper, and nothing more.
  • Yes I have the original Fixed Charge Notice, Coupon-mad and the tickets too. It was Burgess Hill and May 2014.
