Waiting on employment tribunal decision

Hi all,
I had an employment tribunal hearing which lasted 3 days in September 2016. At the end of the hearing I was informed by the judge that the decision would not be made on the day but that the panel would have to meet again and I would recieve the decision within 4 to 6 weeks. I have now been waiting 11 weeks so far and still have not recieved a decision. I emailed the tribunal to enquire about this but was told it was still with the panel for consideration.

It's approaching 2 years now since this whole mess started and has been really stressful and I am eager to get this decision bad or good so that I can begin to move on with my life and put this all behind me.
My claim was for unfair dismissal and disability discrimination regarding reasonable adjustments.

Has anyone any idea if waiting this long for a decision is normal? It baffles me that it takes two years and counting for these things to be sorted. Surely there must be an easier and less time consuming method of resolving these issues. The stress alone that this system puts u under is unbearable. Hope someone has some info about how long I should expect to wait for the panels decision.

Many thanks

I can't comment on the time it will take, but if you want to complain you can do so by contacting the Employment Tribunal President, the process is laid out here.

Unfortunately reserved judgments in general seem to be taking longer to come through recently. Reserved judgments made by a full panel, as in your case, tend to take longer anyway because the whole panel needs to find a time to reconvene and discuss their judgment, which is a more difficult exercise from an administrative perspective than simply have a single judge coming to a decision. Hopefully you get your decision in the next few weeks, but sadly hearing that it's been 11 weeks since your hearing and you still haven't received the judgment doesn't surprise me to the same extent that it would have a year ago.

  • Thanks for your help. I'm not looking to complain, was just wanting to know if the length of time I've been waiting for a decision is normal practice. I guess I'll just have to wait a few more weeks and hopefully it will come soon. After getting the main hearing behind me and all the stress that comes with it, I thought that all the waiting was over but I guess not lol.
  • Hi, I am interested in how long you waited for your judgement for in the end, and if there was any reason given for the delay? My husband is waiting for a judgement and it has now been about 10 weeks, so anxious to know how much longer we will be waiting. Thanks

Just so you know the OP received their verdict about a week ago, so 14 weeks or so in total and lost their case.

We get a lot of people post here about their ET cases and they're told they have a weak case and often we never hear from them again. I remember the OP posting originally and being told their case was weak so it is at least a positive to hear the eventual outcome of the case.

ET are notoriously hard to win and quite often an individual is blinded by emotion and feel they have a strong case when the reality is quite different.
