Lease company keeping money

Hi, my wife has been looking to lease a car and found one she liked, she was asked to pay £180.00 upfront before the lease company would credit check her etc. No paperwork was signed. She passed all of these things but in the mean time (2 days) found a better deal now the lease company are refusing to refund the £180.00 is this legal?

    We haven't seen any, no paperwork has ever been sent, just paid by card over the phone

    What services do we provide you with?

    We operate two separate services. The first is sourcing the most appropriate method of finance from the most appropriate financial house. This will be derived from the information you supply. It is important that you answer any questions that we ask honestly, as this will enable us to select the right lender for you. The second service we offer is locating and procuring your chosen vehicle.

    What do we charge for our services?

    We charge a fee of £150 + Vat for all orders we process. This fee is payable at application stage and is refunded in the event that your application is declined. This fee can be paid by a debit card payment, BACS transfer or cheque. If you wish to pay be credit card a fee of 3% will be charged. We do not charge fees for processing insurance products.

    It appears to refer to the finance application - hence being declined.

    So they charge £180 for a finance application regardless of whether you order or not, but you cant order if you don't get the finance approved.

    They charge the fee for the application process ie: just filling out the forms if you are declined by the finance company they give you the fee back

    if you are approved just for the finance which it seems you was (see your first post) then you decide not to go ahead with it, they will Not refund you the fee's, after all they are a business and you pulled out not them, not you want to hear but thats how it works

    ps: the credit check and all other checks are the start of the process, which they did then you said i dont want to go ahead
