    Wouldn't you have to renew the insurance annually? Every insurance that I've ever dealt with has to be renewed each year, and this includes insurance policies for a community centre and nursery. A renewal notice with the annual cost is sent around a month before the existing policy expires. It sounds as though you didn't renew the policy each year.

    Can the insurance company confirm when a valid policy was last held?

    If so not renewing / investigating why there had been no renewal would deflect some of the heat away from you

    I'm not sure that it would, it seems to me that it's the OP's responsibility to ensure the renewal (if it's required) is done.
