Thank you again Jim for your advice. I have sent who we think are the previous owners a message on Facebook to see if they have the paperwork or at least know who the building firm were. You never know! We will also check with the Solicitor, but as mentioned before, we were not aware of the underpinning at the time of buying. so am doubtful... Thanks again! :-)
Just to add for clarity - the term actually ended in October 2014. They advised us that we could keep renewing every year at a cost, and also added that they also do five year terms. So as much as we know its their money, the advice they gave and insinuated is that we could be okay for a while and never sold it as an 'extension of time'. But as my mum wanted to sell, she did not want to commit to five years as we thought the house would actually sell by now. Its just that since they said no in October, the way they have dealt with my mum is 'different'. Again, never said we wouldn't pay it. We just can't right now, but that is what they want so we needed help from this forum. Years ago this would have been a reasonable request, but it seems that these days a tin hat is sometimes needed. Making judgements, assumptions and reading between the lines isn't helpful in a time of stress or panic.
There are no excuses here and I have never disputed that it was discretionary. I'm not disputing anything here, never said Santander wasn't within their rights to have their own money back, never said we didn't want to pay, never wanted to sell for the price stated out of pure greed. We just wanted some advice, is all.

No one is being judgemental. Merely responded to your thread title with an alternative perspective. As always there are 2 sides to every story. I personally do emphasise with your mothers predicament. That's little consolation though when the lender, as harsh as it may seem, is totally within their rights. To take the course of action they are. Internally they have to have rules and policies. Simply not practical to micro manage every individual case.
Hopefully you'll find a solution quickly.0
