Returning 'clearance' discounted goods

I purchased a table last Monday from a well known high street furniture retailer which we saw in their shop. It was reduced from £1500 to £445 and was 'sold as seen' as there was a small fault which I wasn't worried about and was the display model from the shop floor.

I paid for the item on the my credit card and had arranged delivery by them. I haven't arrange a delivery date yet and I have decided that the table isn't for me and that I now longer want it.

I have called them today to cancel my order and they have refused to refund me.

I asked to speak with the manager who refused to speak to me and told his sales advisor (whom I had purchased the table from and could hear in the back ground being spoken to) that I couldn't I just change my mind.

I explained that it was within my rights to return the item within 28 days and that by them failing to accept the return was a breach and by keeping my money without delivering the table would be theft of my money and that I would call trading standards. He invited me to do so.

Where do I actually stand on this and how can I deal with this and get my money back?!

    As the purchase was made in a face to face transaction in a shop then unless the table has faults beyond those made known to you prior to purchase then you have no right to return it or have the delivery cancelled.

    Unless a shop offers their customers the right of return, you should always assume that goods bought in shops are non returnable unless they are faulty or not as described.

    Lol, take delivery of the table and sell it on.

    Maybe ask them if you could get store credit and buy a table thats more suitable, might not work but no harm in asking but you might have blown your chances by now.

    You haven't got a leg to stand on. You went to the shop. You bought a table. It's now your table. You just haven't had it delivered yet.

    They don't have to offer you anything.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    If purchased in-store, there is no right whatsoever to return an item just because you change your mind. Your only rights are what the retailer offers via their own returns policy-which in this case is zero. And even if their policy does allow for returns, then sale items and seconds are probably excluded.
    No free lunch, and no free laptop ;)

    Why did you buy it if you didn't want it?

    (I really don't understand people sometimes! Buy an item with the intention of returning it or cancelling a few days later!)
  • We liked it originally and needed a new table and it was a good buy. We since found another table which we liked and offered better value for money.

    Don't think there's anything wrong in that is there?!!

    Well it's definitely wrong from a money saving perspective because you should always do your research before you commit to buy something!.

    It could also be considered morally wrong to make up consumer legislation and lie to the shop saying they legally have to give you a refund when they don't! :rotfl:

    Nothing wrong with it at all. But if so, you must accept that the retailer has no obligation to accept a return, and that you have contracted to buy the first one already.
    No free lunch, and no free laptop ;)
