The fact I do have a loan I'm still paying back is and was not an issue as lender is fully aware of the fact I took it , I still pay it back as well as how much is outstanding.

I am getting my broker to get in touch with lender but even they are confused as to why solicitor did what he did.

Still - what are my options IF lender withdraws the offer? Funnily enough solicitor still wanted to agree exchange date after sending this fax. I told him I will agree date once lender confirms they are happy to proceed so I don't loose my deposit. I may be worrying for no reason at all and lender may get back to solicitor saying everything is fine but I would like to know what can I do if they don't?

When I tried to explain to solicitor he has made a mistake he basically said it is "mortgage fraud territory" so he is not admitting to making mistake. I could change solicitor but he is the seller's solicitor as well :/

Solicitor doesn't work for Estate Agency however law company he works for must have some sort of relationship as he was recommended by them. At a time it seemed to be a good idea to have same solicitor as seller to make the process as quick as possible.

There is a conflict of interest there. You want someone independent to act in your best interests not the sale.
