    t. Did they tell you that you would get enhanced pay? Because if they said you don't, then you don't. An employer is not obligated to give any enhanced rates at all, at any time.

    My local authority (also Scotland) is re-banding some public holiday dates as annual leave. Total amount of days available remains the same and they can be taken at a time of your choosing unlike the fixed public holidays...but it does mean those who received enhanced pay for them will no longer do so. Perfectly legal though...
  • It's in my contract that I get paid double time plus a day off in lieu for working public holidays but they've changed the dates for the public holidays in my department if that makes sense?

    It does - but they can do that. Employers don't have to observe public holidays at all. As I said, they also don't have to pay any extra for working them either.

    Technically, the people getting the enhanced rate aren't entitled to it as they aren't working public holidays. Now, it might be possible, in the strict letter of the law, to force this issue in court. How long do you think your short career will last if you do? And if there is a big enough fuss, the likelihood is that the local authority will go down the route of scrapping enhancements for everyone. Which they can do and many already have. So be prepared to be popular.

    Be rational - you get to spend both Christmas and New Year with family and friends. They don't.

    Thanks for the reply. I don't want to cause any problems and of course I don't want to stop others from receiving the enhanced rate as they obviously deserve to get it. I was curious more than anything else.
  • And why did you delete your original post? Do you really think that people give their time just to help you? Don't you feel ANY responsibility for leaving a helpful question and answer that could help others in the future?

    Hi I work in Scotland for a local authority. I've only been there a couple of months and wanted to check if this was acceptable or not.

    My department is the only one to work 24/7/365 as it deals with emergency repairs etc.

    I work weekdays only but colleagues obviously do shifts at the weekends too. I've been told today that because of us working all year the departments public holidays (which attract a higher rate of pay) will be 25/12, 26/12, 31/12, 1/1 and 2/1. While of course I want my colleagues who are having to work such anti social days to get their overtime, I was wondering if the council were obligated to pay those of us who work 27/12 and 3/1 would be eligible for the enhanced rate too since if we worked anywhere else we would be.
