Still waiting on IPA decision

Well I still haven't heard if the OR wants me to have an Income Payment Agreement yet. It's been 7 weeks since I was declared bankrupt. When I telephone they just say a decision has not been made yet. Did anyone else have to wait this long?

They have until discharge date to put a proposal to you - although usually some weeks before in the event they need to apply to the courts for an order compelling you to make payments if you do not agree.
I keep parroting the same advice on here, but don't poke the bear! If the OR needs to get in contact, they will. You have no obligation to contact them other than to advise of change of circumstances, but if you keep popping up on the radar, there is a greater likelihood of them doing something that you will not like.0 -
i would echo DontPoketheBear, i mean NotEvanAPot, head down, hold your breath, fingers crossed etc0

I agree about not poking the bear but I've been told if they decide they don't want an IPA from me they will not contact me to let me know. The only way of finding that out is to contact them.0

why do you need to find out? assume you don't have one until they contact you to say you do - innocent until proved guilty?0

Scobby99, my advice in this situation would be to review how much is available based on the conversation had a few weeks ago. Negligible amount (<£50) then don't expect to be at the top of some administrators list, you could be at the bottom of a large pile that will take months to clear. If an NT tax code will mean that a significant amount can be recovered during the period until end of March 2017, you will probably receive something through the post within 12-16 weeks from BR date. It takes the Insolvency Service 8-12 weeks to provide report to creditors, which is the primary objective in the initial stages.
To clarify, the examiner on behalf of the OR doesn't decide if you will be subject to an IPA/O, your financial situation dictates this.
Relax, they cannot recover amounts prior to an agreement or order coming in to force, so just live your life and don't sweat the small things.0 -
They sent the report to creditors two weeks ago. I have a copy of it. It's very difficult to predict what they will do in respect of an IPA as my Disability costs vary greatly from week to week depending on how my health is0
-
As stated, you cannot predict what they will do, it is not a human decision, it is based on your financial situation. If such a situation is variable, they may request regular submissions - this is unlikely however, because it costs man hours to go through your submissions, something they have too few of already.
If your income and expenditure means an IPA/O is reasonable, they will contact you. I know it is both difficult and not what you want to hear, but just wait to see if you receive something from them. The Insolvency Service won't just forget about you, but having no contact from them is a positive sign.0 -
It was nearly 2 months from BR date before I heard, and it was only for a small amount, I guess the bigger fish get dealt with first.0

I concur with all the others - don't pester the OR. Keep your mouth shut and speak when you are spoken to. There is nothing to be gained from keep calling them. You are now BR - get on with the future, live within your means, re-calibrate your personal financial behaviour and plan for a better financial future.
The OR will contact you if they want you - and an IPA will not be back dated. Deal with it if it happens but until then - leave it alone and relax
