Can I sue my employer?

So long story short I started a work assignment trough an agency whilst I was studying at my university.

Basically I was completing work for the university itself which was paid trough this agency.

So this is how it goes... I finished my degree in June or July and started some work back in April/May. The work was paid on a hourly basis by filling in the time and waiting for my manager approval. Once complete I was paid.

As I finish my degree I moved overseas, but continued to work remotely for the university till the work was completed. The agency says that trough a change in their policy they terminated my employment and need to reinstate it, requiring me to gather my passport and documents such as proof of address before they can add me on the system. So despite the fact the work was done I can't enter the hours or get some of the older ones paid.

I haven't signed anything agreeing with these changes or to cease employment.

Why do they need my documentation again In have no clue since they gathered all this when I fist registered with them and now want me to take time off to fly to England just to show the original copy of my passport and utility statements (which I don't have as I no longer live in the UK).

What would be the most sensible approach to find a solution here?

    What does that have to do with suing them?

    But any employer is entitled to ask a new employee for ID and other documents to prove their qualification for the post / eligibility to work. For whatever reason you're classed as a new employee.

    How long had you been working for them? If under 2 years they can let you go for any reason.

    I would ask the University to intercede on your behalf. I think the agency should be able to add you to the system to get you paid as a temporary measure. If you want to do more work, you will have to figure out with the agency how to meet their interpretation of the rules.

  • The work was done already but the person that approves my hours at the university can't get then on the system because technically I'm not employed by the agency. They only have to send the hours it's up to the agency to pay me. They don't really want to deal with it after this point.

    So I'm trying to figure out how to get paid for these without having to fly over to England. Can they actually do this? I mean the work was done, I didn't had a document saying my employment ceased for whatever reason!!

    Would they be happy with certified copies, since you are now located in another country? I appreciate that it's an annoying hassle, but they have some laws they need to adhere to, and I think that is what is getting in their way.
  • No, I actually offered to do this.

    Do bare in mind they have the original documents, I used them when I first registered with them. The problem here is when I terminated my degree someone screwed up and terminated my employment as well with the assumption I would not be working with them again. Once they realised this they then asked me to re-register, but unwilling to use the previous documents which are still valid.

    So it's not like they don't know me or have reasons to doubt the documents are invalid

    Have you actually asked them about certified copies? You should be able to get copies certifed at the British Embassy .

    You coul also write to them and point out that your employment was never terminated and that rather than you registering as a new employee they need to correct their error and reverse the incorect termination of your employment on their system, which should resolve the proplem.

    Set out in wiriting that as a result of their eror you have been cuased financial hardship as you have not et been paid and that if they are unable to resolve the issue and are unable to accept certifed documetns then you would have to fly back to the UK at further expense. Ask them to provide you with written details as to why, given that your removal rom the systemwas an eror ion their part thy cannot correct the error manually rather thatrying to force a re-registration.

    Ask them to confirm also that however they resolve the issuethey will ensure that their records shwo that you have remained in continuous employment with them thoughout.

    it may be that the re-registration is the simplest option for them from an dmin perpespective and that you need to try to get it moved up to a more senior peosn who can look at other options.

    Can you not get the university to pay you directly?
