Remortgage from joint to single with no divorce/separation

Hi. My husband and I have a 20 yr age gap. We bought our house 20 yrs ago and due to a series of silly financial decisions (hindsight etc) still have £130000 to pay and only 5 years left. Due the surprise arrival of our now 5 yr old son we switched to interest only (as we were skint with a baby on the way) and are now in a position to change back to repayment but will need to extend the term. My husband no longer works - he does the bulk of the childcare etc, whilst I as a teacher am the main wage earner (and have been for some time). We decided that as only I am working it would make sense to remortgage just in my name but were told today by one mortgage adviser that we can't do this as one of the former owners would still be living in the house. Can anyone shed some light on this? if this is the case then we face crippling repayment amounts for the next 5 years or else we have to sell and buy somewhere else just in my name. I feel we are being discriminated against because my husband is 20 yrs my senior!
