My wife has had a neurological condtion now for 3 years, she works in a school as a teaching assistant and is paid by the county council she has 20 years plus service in she is 53. She was working part time after been off for over 12 months , Her employer started to ask her to increase her hours with the hope of returning FT which she was at the agreed rate of increase ie so many hours extra per week etc.
Then out the blue they told her basically your back Full time from now on even thou she was nowhere near back to FT hours.
Basically since going back FT she has had two periods of been off totally exhausted, she has been assessed by Occupational health who state in the report that her hours should remain Part time and the increase is clearly having a adverse effect on her health.
On thursday this week she has been summonsed to a meeting she will be accompanied by her union rep and will meet wth her prior to discuss the situation etc. The school have instigated the meeting. They have stated catagorically they will not employ anyone PT
She is thinking about to see if the school will instigate her been pensioned off throu ill health. The questions are if they agree to instigate the process will she still be required to work FT during this process which could take a while i presume, Plus if she is not required to work will she still be paid, obviously i presume that if they agree she can return PT till the process is complete she will be on PT money which she was when she was working PT.
I gather that the pensioning off process is on different levels of capabilty etc. Obviously if she is pensioned off on any level i would imagine that she wont be able to work for the county council.
This whole situation is seriously having a adverse effect on her health i just wish i earned enough to enable her to totally give it up and put her feet up. I /we also realise she will be able to access her pension anyway in 18 months or so, which also raises the point if she is pensioned off early will she still be able to draw what she would have been able to ie 25% lump sum etc althou i doubt if she would anyway.

Indeed.
I responded is some detail twice in the previous thread and have little to add.
Any question of being "pensioned off" comes down to the terms and conditions of her particular pension scheme.
If that is not a possibility then, as stated previously, her only protection would be if her employer is failing to make what the law would regard as "reasonable adjustments". That assumes that she is actually disabled for employment law purposes. Without wishing to sound harsh, if she is "only ill" (ghastly phrase) then they don't have to make any adjustments at all.0
