Oh dear...

Hi all first post here but i am in need of some advice.

I have a home that was left entirly with me after my ex wife left me with everything.

Earlier this year i desided to sell the house due to loosing my job due to stress and depression and to start fresh. The house has recently sold but my ex's name is still on the land registry and its holding up the sale. She has been contacted and is aware of this and is chasing her solicitors for them to remove it asap so the reason i am selling is because i have so many debts i needed to sell it to pay them off.

Northern rock who i have my mortgage with are demanding payment that i cannot make as i have lost my job and unless the house isnt sold, or i pay them approx £2000 i will be attending court on the 1st of october and they will enforce a repossesion order. I also owe the council approx 700 pounds and that has gone to a balif and has now turned into £2151 including costs etc that i have to call them back within 5 days of this post to arange a payment plan.

I have been looking into bankrupsy and IVA's but i dont know what would be the best solution for me due to not being in employment and technically owning my own home... and as the court hearing it in a few weeks i need some help.

PS
*Total ammout of debt is approx 25k.
*The house sale equity will clear all outstandings.
* I have nothing of value to sell.

Thanks in advance :)

Are NR aware of your house being on the market and could your solicitors write to them informing them how far into the sale you are?

Again if you could let the council tax people know the same it would hopefully help a little, not sure if they would accept a lower payment in the meantime pending but speak to these people offer them a solicitors letter see what they say.

As for your ex the more costs you incur the less equity in the house does she not see that? Or has she already had her financial cut?

Tell your solicitor to contact NR & Council and tell them where you are up to, also to tell them about Land Registry problem, it may help, but as a cautionary tale..... Some building societies will persist in taking action regardless of solicitors contact. I got stung 8 years ago by Abbey - thier policy was 3 months missed = repossession starts. My ex stopped paying the mortgage on leaving, i sold the house & exchanged contracts within 14 weeks but couldn't get another Abbey mortgage because their repo process had started.

Can your ex not apply direct to the Land Registry to have her name removed? I guess you have some form of written agreement that she no longer has a claim on the property?
