Lived overseas after IVA

So in 2009 life was tricky and looking back I feel I was almost forced into an IVA by my then bank. As it happens I was then made redundant, worked in UK for a while longer and left to work overseas (I have dual nationality and the work was more freely available in the other country). I was clear with the company I arranged the IVA that I was moving overseas and intended to continue paying the IVA. After about a year (2010) I asked for a payment break for 2-3 months and from there never again received any correspondence from that company? Did they just sign everything off and make me bankrupt without me knowing; I don't want to dig to deep in case things pop up and bite me in the butt when I should've just kept my mouth shut.

I've not thought much about it until now but it looks like we might be returning to the UK.

So where do I stand financially, in this country I have a great credit score and everything is in my married name.

Any advice would be great.

  • Search the Insolvency Service website or Google your name, the term bankrupt and a previous address.

    If there is anything out there, it's documented and freely available.

    And if there are no results returned? Then just carry on as normal open a new bank account in married name etc?
  • Have you maintained a correspondence address in the UK since leaving? It may be worthwhile completing a Subject Access Request to each of Experian, Equifax and CallCredit (£6 total, £2 to each) which will use previous addresses to check your status in the UK.

    You will not be committing any wrongdoing by applying for an account in a married name, but you must give your maiden name if requested, along with confirming that you have had an IVA in the past, again, if requested.

    Most high street banks will only offer standard accounts to those arriving from overseas anyway.

    As either nearly or fully 6 years has passed, the Limitations Act 1980 may have come in to force on unacknowledged unsecured debts. May be worth your spending some time reading up on and checking back through calendar dates for previous correspondence.
