How to proceed with 1st Credit...

Hi All,

Quite some time ago 1st Credit contacted me regarding an unknown debt.

I sent a prove it letter and have finally had a response but they have sent no actual documentation.

They have kindly asked me to call them within 14 days, of course I am not going to call them as I requested paperwork to support their claim and have sent none.

Do I just wait for the next letter or do I send them a letter? if so what do I send?

    Hi,

    After you have sent a Prove It letter.

    If no evidence is forthcoming but letters demanding payment continue to arrive, then you should write a second letter with COMPLAINT in capital letters at the top.

    Dear [Debt Collection Company],
    COMPLAINT

    On dd/mm/yy I asked you to prove my alleged debt to xxxxxxx. I attache a copy of my letter.

    The FCA (1st credits regulator) rules are clear that ” Where there is a dispute as to the identity of the borrower or hirer or as to the amount of the debt, it is for the firm (and not the customer) to establish, as the case may be, that the customer is the correct person in relation to the debt or that the amount is the correct amount owed under the agreement.”

    I do not owe this money. You have failed to produce any evidence that I do. If you do not cease contacting me about this debt I shall be complaining to the Financial Ombudsman.

    [Please also delete the incorrect entries from my credit records.]

    If they ignore this second letter, then I suggest you go to your local Citizens Advice Bureau or phone National Debtline and ask for help in putting in a complaint to the Financial Ombudsman.

    Yes.

    You have asked for proof of the alleged debt, they have not provided any, mistake no 1.
    Instead they have asked you to contact them, mistake no 2.

    These idiots are still operating under a temporary licence from the FCA after been severely mauled for bad business practices a few years ago, you have asked for proof of a debt they claim you owe, they have not been able to provide any, therefore they should desist all collection activity forthwith.

    Send the letter.

    Are they still contacting you using the 1st credit trading name ?

    1st credit limited and 1st credit (finance) limited FCA (financial conduct authority) licenses ALL (they had about 8 interim licenses) ran out on 30.09.15.

    As of March 19, when the FCA register was updated, they have a new trading name Connaught Debt Services

    This means (and i checked this with FCA) that between Sept 30 - March 19 2016, they effectively had no permission to act as debt collectors or enter into credit agreements.

    Further to the above, they also have special restrictions placed on them since 2009 ( there is a link on FCA site)

    Thanks again for taking the time to reply.

    I will get a letter drafted up and sent this week.

    They are still using the 1st Credit trading name in the letter, Just checked back and I have had no contact since Feb 15.
