All,
Meeting taken place and the outcome was a sorry, I am right and an offer of a 5% accepted, with a "this was overlooked and this in no way compromises your position". They accepted that the criteria should have been communicated. I was not the only person to have experienced this...
Nothing ventured, nothing gained!0 -
I'd suggest that you ask the to provide confirmation of the terms of the bonus scheme for future refernce, if they have not already done so.
Where I work, there is a bonus scheme. It is discretionary and the derails are reviewed annually, and provided to each individual eligable. Payment f a bonus is dependent on a number of factors includingthe individual's performance, the performance of the company as a whole and any complains made by clients about the individual. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
I'd take a step back - the letter said yes bonus, the contract came after the letter but neither said that there was OR WAS NOT a bonus payable. Therefore it's reasonable to believe that the bonus was still a term of the agreement as it wasn't rescinded.
Either way it's clear they're trying to stitch you up, so look for another role and be prepared to fight for what they owe you.0 -

I have been in my job for almost 8 years now.
However 18months ago I resigned to join another company; I was happily working my 3 months notice period.
In the last 3 weeks of work, my manager took my aside and turned me around. My package was improved and so I decided to stay with the business.
.....
if that came out of the blue 3 weeks before leaving that says a lot about the the way they were thinking, wait to the last minute and see what they can get away with.
Even after a complaint they stitch you up for 5% not the 10% promised.
They also left the new employer let down, lets hope this is not a small world industry as word may get round.0 -
Most bonus schemes are discretionary as depend on how well the company does etc... I agree with the above, check the staff handook/policy, it probably will be clarified there, and if your contract says you have to adhere to the terms and reference of the handbook/policies, they are covered that way.
Frankly, what's the point of having a bonus scheme if it is assured no matter what. Might as well increase the salary in the first place. You should have asked more detail when it was offered (assuming you were not on a bonus before).
Saying that, did you ask your manager what are the terms of the bonus and the reason why you were not eligible?0
