Bankruptcy in Scotland

Hi I'm looking for advice i was in a car accident in may and I'm in the process of claiming personal injury (no loss of earnings) for pain and suffering my bankruptcy forms should be in this month I'm applying for a map but it might be rejected so it might go through as a full bankruptcy. Anyway my question is when my personal injury is settled will this be taken from me? Google is saying no but more often than not Scotland and England differs.

    In Scotland bankruptcy is called sequestration, the Scottish equivalent or the insolvency service is 'Accountant in Bankruptcy' https://www.aib.gov.uk/

  • Thank you mwarby. I know it's sequestration but it's pretty much the same thing :) I'm going to ask my advisor on Tuesday when she's at work but just wondered if anyone had been through it. I still have apps for the Personal injury and if it's going to be taken I'm just going to cancel the claim saves me making all these journeys into Edinburgh city centre. Thank you for your reply
  • It seems even my money advisor does he know the answer :/ she's going to do some digging. I have emailed AIB but as yet haven't had a reply.

    Hi. I don't know if this is any use but my friend went through a company called Pay Plan rather than sequestration. They have been very good and all her payments get divided up between the banks she owes to in full.
