Empty threat?

Hello again! This regards our good old friends moorcroft.

Requested CCA, reply back along the lines of 'we cant supply this however our client says you ordered goods blah blah blah..please call to propose how you wish to pay'....

today i receive a letter from moorcroft offering me to settle at 75% of the debt to prevent more serious action.

Is this 'serious action' an empty threat? They cant take me to court can they?

You ordered goods from me. I want the money (£1,000,000) by next tuesday, your kids to sell into slavery, and your sister - but only if she's cute.

And you know you did, because I said so.

Seriously, the CCA is the documentation for the loan. Without it the debt is unenforcable. It becomes an offence on their part if they can't produce it after a certain (poss 30 days) length of time.

Until they produce the CCA, they can do nothing. Th only defence you would need against serious action, is the absence of the CCA.

This sort of letter seems to be a standard Moorcroft threat, often issued near the time when the CCA deadline is approaching. Last ditch attempt to get a lump sum as they know they can t force you into a legal regular payment scheme.

When did they sign for the CCA letter? After 12+2 days they can only enforce the debt if they take you to court to get permission. After 12+2+30 days, they cannot enforce the debt. When can you send the bogg off letter?

  • the royal mail track and trace has never updated as to when they signed for it. (I sent it on July 4th though)
  • should I ignore this letter?
