Capquest have returned......

Hi guys,

Had a debt back in 2010 with Barclaycard which Capquest were the fourth dca to have a go at it. No one could provide s copy of the agreement at the time. Capquest finally admitted defeat and said dent would remain active but no collection activity.

Fast forward nearly 6 years and 2 changes of address. I have now started to get the recorded message calls from Capquest asking me to press 1 and speak to someone. How they got my phone number is beyond me especially as I wasn't called at my previous address I was there for 3 years. Plus every time moved had new phone number.

My question is now that they have had the debt for almost 6 years they have sourced out a phone number to give it one last attempt before going statute barred??? The calls are every 3 or 4 days so I guess it's not on their top priority or would be having a call every couple of hours!!! I've had no letters.

Is it a crafty case if I ever did speak to them (no that I would) and acknowledged the debt would this give them another 6 years to chase???

    You can't acknowledge a debt except by payment or in writing. But, if you do, then the clock re-starts, assuming you haven't already reached 6 years and they haven't started a court claim.

    A cca request MAY count as acknowledgement but I am yet to see a court case that hinged on that.
  • I have had no contact with them since end of 2010. They keep calling me and I keep ignoring them. The CCA request was also back in 2010. Appears not on their priority list so let's see.......

    Well it seems you have two weapons with which to fight any future court claim.

    No credit agreement, and now the Limitations act.

    See if they can be bothered to write to you or not.

    Perhaps a last minute effort before they're statute barred?
