Gladstones Court Action

Hi,

Gladstones have sent me a court summons form for a parking ticket.

I did not respond to previous letters as my dad was ill.

I am the registered keeper but believe my dad was the driver and he's passed away now.

How do I respond to the court form?

    Obviously yes.

    Alternatively:
    - Fight and win - pay nothing
    - Fight and lose - pay less than what they are demanding, as the claims are always artificially inflated, and a court would probably award a lower amount.

    Winning is the most likely outcome against Gladstones, as long as you do your homework. Most of their claims are very poorly argued.

    That would depend on how much they want. They are under investigation by the Solicitors Regulatory Authority for trying to overcharge. Please give us a breakdown of the amount. Better still post the LBA.
    You never know how far you can go until you go too far.

    Which PPC is it. Some do not use Keeper Liability so you could defend it while keeping your dad out of it.

    Try not to name the driver as even in death they can get cash from the estate.

    PS It's going to be painful in terms of your memories but what would your Dad have told you to do.

    OK.
    No need to panic.. no need to do anything in a rush, but be very mindful of the deadlines which you must not miss.

    You have 14 days to acknowledge the claim which you can do online, but leave the defence blank.

    This will buy you more time to file your outline defence which you must do in 28 days from the date of the claim (plus 5 days I think, others will confirm).

    My advice to you now is to have a read on this forum on other court claims.. particularly Gladstones ones (plenty of them), and await further advice from those more expert than me on this thread.

    The good news is that Gladstones regularly lose court cases when they are defended properly, often with help from this forum or Pepipoo, so there is a very good chance you won't be paying this.

    Have a good read about keeper liability, and how the PPCs must jump through certain hoops to properly transfer liability from the driver to the keeper.
    They often fail on this score.

    Also have a good read of the Newbies thread at the top of this forum. While you obviously can't appeal now as it's much too late, it will give you a good background to the issues and help you understand what is going on.
