creditors, balances etc

Hi, I am doing the questionnaire in advance of my OR interview, I have a couple of questions re creditor-I might have a few more over today and tomorrow, so thank you, as always, to all you fine people who populate this forum and make such an effort to assist, I look forward to joining your ranks when I might have a few pearls form my experience
  • in instances when debts have been passed to agencies who does one list as the creditor, the agency or the original creditor, this applies to most of my overdraft and credit card debts, which were passed on some time ago
  • Is it necessary to call creditors and get exact balances?, I can only work off the most recent letters I have, which may be inaccurate due to interest/charges etc-i.e do the balances need to be 100% accurate
  • what happens if I miss something, pretty sure I have everything but you never know
  • Am assuming all utilities are included?
  • parking tickets?! (I have one)

      The agency who has the debt now and the original creditor, I listed mine on the original paper format as, Lowell Portfolio, Origin: TSB. The important thing is to list what you know, the interview will clarify the unknown anyway.

      If using a Debt Relief Order it would be more prudent due to the limit, in your case it is not essential, use the most up to date balance you have available as the OR will no doubt check.

      Bankruptcy is a 'catch-all remedy' in that any creditor not listed on the form but a qualifying debt, would still be included, the OR will contact all known creditors and notify accordingly, with a final creditors report produced at the end of the bankruptcy. It is important that you notify the OR of any additional creditor information so they can make contact, likewise anyone who contacts you, pass them on to the OR's office.

    • Am assuming all utilities are included?

      If any unsecured debts exist at the time of the order they are included, I'm guessing this is in relation to your EDF account?

      Parking tickets.

      Differentiating ticket type.

  • thanks, yes the EDF account, but also have a water bill, the balance on EDF say is to end of August, but the BR order was made in October, so will the OR request the debt at the time of the order from EDF, as obviously I don't have a subsequent bill yet

    Energy suppliers should recalculate your bills so that they are effectively reset to zero on the date of your bankruptcy.

    Almost certainly - I don't know of any council in the country that still enforces parking contraventions through the criminal courts. You should just list it - in the unlikely event that it is not a provable debt, I am quite sure the OR will let you know.
