    By the way, the percentage to use is 12.07% to 2 decimal places. My employer uses the even more accurate 12.069%. The resulting paid time off cannot be rounded down but can be rounded up.

    the oft quoted 12.07 is based on a 52 week year which is already an approximation, they could go down to 12.032% if they used the full year of 52.143weeks

    I made a mistake on my previous post. We do not get any comfort pay on the 1st hour of work, but the 2nd. So effectively it can't be claimed that Holiday Pay is paid on that 1st hour, and therefore you would assume it has not been accumulated into any pay.

    We have never been informed exactly how Holiday Pay works. We just get paid an hourly wage of £7.50 + Comfort Pay (Pay to cover any breaks we have during the working day) added to our pay after working a certain amount of time.

    All of us 'workers' work long days and over a month, on average, our hourly wage + comfort pay would amount to the Minimum wage + holiday pay requirement of 12.07% if you divided the amount we earn by the hours worked.........

    Would this, by law, be ok in terms of covering our employer?........

    All the payslip has to show is hours worked and the amount earned and that is enough to 'prove' that holiday pay is being paid?


    The issue of Holiday Pay at work has now been raised and we will hear back from management in due course.

    In terms of averaging out of wages, technically it seems it could be argued that they are paying us Holiday Pay, though this isn't clearly indicated in what we have been told in the past + the way our wages are paid indicate that Holiday Pay has not been included in our pay. So we'd like to think we should be getting Holiday Pay on top of what we are already earning. But we will see. That is up to our employer. Either way - it seems Holiday Pay needs to be clarified and more clearly indicated to us in the way we are paid.
