Hi im goinf bankrupt on thuraday i have a ohone xontract with o2 got 1 yr ago my oartner says include in bankruotcy and the devt adviser at cab said i could include it. My partner said he will get me a sim only deal. Will o2 want ny phone back or shall i keep xontract i have now its 60 a month

Need to check your contract with O2.
They do have a scheme where your phone purchase and tariff are 2 separate contracts under one payment. You may find that the phone is already yours and your payment will reduce to reflect this after one year.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. Separate to the question it might be possible to continue the contract if the OR agrees to the expenditure and the agreement with o2 is okay with insolvency.
I only mention this because once your bankruptcy completes your credit worthiness will be zero, by maintaining an active credit account you could get a head start on rebuilding credit worthiness and can keep a mobile phone contract with the option to upgrade when appropriate.0 -
I have 2 contracts with my mob provider in my name, although paid for my mu husband. They've not been included in my bankruptcy. They're paid monthly by DD.0

I had a sim only contract when I went BR . I didn't include it on any of the paperwork & the OR didn't ask me about my mobile phone. It just carried on as normal. I was up to date with all payments though.SPC 8 (2015) #485 TOTAL: £334.65
SPC 9 (2016) #485 TOTAL £84
SPC 10 (2017) # 485 TOTAL: £464.80

I had a contract with 02 before my bankruptcy and it wasn't included I was upto date with all payments, I was allowed to keep the contract and 02 didn't close the account. I'm still with them now. It's been good for my credit file 6 year payment history. They stuck with my through my bankruptcy so they have a customer for life!0

I had to make this decision today and felt the same as A4445 says below. I spoke to the OR about it and she said it was up to me, that it would be OK for me to keep but that if I ended my contract then anything owed to them could be included in my bankruptcy. I got a really good sim only deal for about a third what O2 were charging. On one hand, I feel actually quite bad about it as they have always been good and the account has never been in arrears. But on the other, I don't suppose they have felt that bad about charging me way over the odds for the last 10 years, and they will get most of it back I expect, just not in the next few days.I had a contract with 02 before my bankruptcy and it wasn't included I was upto date with all payments, I was allowed to keep the contract and 02 didn't close the account.
