    Just a thought - have a good read of the T&C from Cosmopolitan. Don't a lot of them have a phrase about "We reserve the right to substitute a similar prize of equivalent value"? Obviously, that's to stop you complaining if you get a blue wossname when the comp was for a green wossname - but wonder if you could use that as leverage to insist that Cosmopolitan provide a pair of diamond earrings from a different jeweller?
    I need to think of something new here...

    Hi. Not getting anywhere at the moment. Emailed IPM - no reply, emailed Cosmopolitan Editer - no reply. Sent a letter enclosing all the emails I have received about nearly 2 weeks ago but not heard anything as yet. I think I will try and give them a ring as I thought they would send maybe an autimated reply saying they had received it, I sent it signed for.

    Will keep you posted, it seems too large a prize to give up on just yet. Tried to leave a message on Cosmopolitan fb page but it seems you can't even do a pm to them unless I am missing somethin.

    Contact the ASA, if you don't get a response on twitter put your tweet on here and if a few of us sensibly like and rt it and state how appalling it is it might make them take notice. If you tag asa in the tweet they wont do owt without a proper case but it might make cosmo wake up and take not.

  • Out of curiosity has the ASA ever helped secure an AWOL prize before? Every outcome I read usually results in a metaphorical slap on the wrist which is so frustrating as to me (and likely the prize winners) that means nothing.

    I would do as others state and tweet as much as possible. Is Cosmopolitan a part of a larger print organisation? Perhaps try and find the email for the CEO of the publishing house also.

    8.21 Where Hearst Magazines runs a competition with a promoter such that the promoter is responsible for the selection and/or the provision of prizes then Hearst Magazines shall not be responsible for or have any liability for the provision of such prizes.

    The “promoter” is whoever is running the promotion. Some promotions, those in which more than one party benefits (for example, in terms of branding, promotion or revenue) are joint promotions or co-promotions. In joint promotions or co-promotions all parties are considered responsible and will be named by the ASA in the event of a complaint. A company that provides the prizes or gifts for a promotion is not necessarily a joint promoter.

    Promoters are responsible for all aspects and all stages of their promotions (Rule 8.1). This includes ensuring agencies, intermediaries and staff are able to deliver on the promotion (8.14). Promoters must be seen to deal fairly and honourably with participants and potential participants. Promoters must avoid causing unnecessary disappointment (Rule 8.2).
  • Thanks everyone. Have had a text response from ASA today as I rang them to see if they had received my letter and attachments. They assured me on the phone that they would be looking into it so will keep you posted.
