Remortgage, charge on house

Hi all, bit of a saga this one so I'll do my best to explain.

We are currently trying to remortgage our house and are having to register the property with Land Registry. The conveyancing solicitor has found a charge on our house from an old debt that we paid off in 2009. Here's the problem.

-We did have a letter from the debt company saying we had satisfied the debt, but we can't find it.
-The debt company no longer exists and the owner is in prison for fraud.
-The debt was subject to a court case in 2003, but there are no court records.
-We have tried contacting the court, soliciters etc but no one has any records of the debt or the court case.

This charge doesn't show on our experian credit reports so we didn't know it was still there. Does anyone have any idea how we go about removing this charge from our house?

    When you say "the debt company no longer exists", do you mean it's a limited company which has since been dissolved?
  • I'm not sure, I'm afraid. All I know is that the company is no longer trading.
  • Hi, just spoken to my wife, and yes the debt company was limited, I'm not sure if it was dissolved but it is definitely no longer trading. The conveyancer was hoping to track down a liquidator and get some info that way. However this debt was paid off in 2009, so there might not be any records.

    What I'm wondering is, if we can find no records, how can we get the charge removed from the house?

    Well, does the company which holds the charge end with "Limited" or "PLC"? If so then look it up on Companies House website and you can find out its current status - not every company which is "no longer trading" has actually ceased to exist.

    Or tell us what the company name is - others here may have encountered them before.

    Ultimately if you can't get the company to discharge their security then you can do it via a court action.
  • Hi, It's limited, the company name was Gentry. I couldn't find it on the Companies House website.
