Two Contradicting Letters

Well i am looking for some advice reference two letters i have received this mornig please.

One is dated 6th October 2016 and is from HR and says "I have pleasure in confirming your post working 15 hours has been made permanent with effect from 16th September 2016" and includes a copy of my contract.

Now this is fantastic news and i am over the moon and I have then gone on to open a second letter that has arrived this morning also both with the same dates on the envelope 21/10/2016

Now the second one is dated 13th October 2016 and goes on to say "your manager has advised me that your fixed term has been extended until 4th November 2016"

As you can see I have been made permanent with a legal binding document but then told my fixed contract has been extended. A fixed contract cannot be extended if i am now permanent surely. Where do I stand on this because it's really unacceptable i am sure you will all agree.

What do you all make of this please?

Most likely this is just an administrative foul up and can easily be resolved next week.

However, keep in mind that the word "permanent" doesn't really mean what is says in employment!

If you have been employed for less than two years you can be dismissed for no reason at all, "permanent" or not. Equally if a "permanent" job becomes redundant you can lawfully be dismissed after any length of service just by paying the fairly minimal statutory redundancy.

And equally, continuous service under any kind of contact of employment is exactly the same thing. So two years worth of fixed term contacts means the same thing in law as a so called permanent contact.

You could get this clarified or an alternative route is say nothing and pull out the appropriate letter in Nov if something is said.

If there os no significant contractual change in practice it makes no difference.

Significant would be things like pay,notice,holiday,benefits...

The only way to know which letter you should have received is to ask the question when you go to work on Monday.
  • There is no such thing as a "permanent" contract.
