Euro Parking Services - Help Please

First and foremost may I apologise in advance if I've posted this thread in the wrong area etc, I've read so much information I'm completely lost hence my appeal for help!

I'm registered disabled with significant mental health conditions, I don't cope very well and this matter is making me feel very suicidal. That may sound stupid but it's true, I'm really frightened.

On Saturday whilst parked on a private site operated by Euro Parking Services I received a PCN despite having a valid permit displayed in the car. The PCN was issued as the ticket was not displayed on top of the dashboard, or in the words of EPS;

"As per the Pay and Display car park's terms and conditions, all vehicles must clearly display a valid ticket to park in this area. Unfortunately when the Parking Charge was issued a valid pay and display ticket was not clearly displayed in your vehicle. Your vehicle was left unattended on Private Property, therefore giving you no authorisation to park. There are sufficient signs in the car park warning motorist that should they park their vehicle without clearly displaying a valid ticket this will result in a Parking Charge being issued to the vehicle. The signs are prominently displayed in and around the site and are obvious to any person who enters the site. It is incumbent upon motorists to read them. If they choose to ignore them then they submit to the terms nonetheless".

The ticket was on the dashboard but not on-top of the dashboard, it was stuck to the dashboard/ instrument cluster but clear if the attendant had looked inside. They have photos but only of the top of the dashboard!

Anyway, I appealed online on Sunday without knowing I should have waited for an NTK, they now tell me that because I've appealed at stage one they dont need to issue a NTK as liability and contact details have already been passed??? Have they?

Anyway, they are a member of IPC and there letter states that my next stage is via IAS?

Can anyone help me or send me links to a template I can use to try and win my case? I have the ticket, I sent them a copy but they don't care.

I'm lost. I parked legally, I've sent them a definition of "dashboard" but they don't care. Stupid me (Aspergers and bi-polar1) I didn't take a picture myself :-( I was shocked, emotional and simply couldn't cope on arrival back to the car, I had to come home quick or I know I would have self-harmed. It's stupid but that's my coping mechanism.

If someone can help me I'd be so very grateful. I have no clue what I'm doing, if someone would be so kind as to give me instructions etc Or even point me in the right direction, I'd be so grateful. I'm confused about everything but moreso the fact I haven't waited for a NTK?

    Scott, that doesn't sound stupid at all - that sounds very worrying for us to read how this is affecting you.

    Speak to friends & family and read our replies so you all know the plan of action. You did not appeal at the 'wrong' time because this awful firm would NOT have cancelled it even if you'd waited for a NTK.

    But that's not a reason to pay.

    Well yes but it's not awful - it just means that you've admitted to being the driver so they do not have to (they cannot in fact) issue a Notice to the keeper.

    Did you tell them about your disability, in your appeal, did you say how this was affecting you?

    Who is the landowner there?

    If unsure and you can't find out from Googling the place, pay £3 to get details of who owns the site and send them an email or letter, explaining about your disablity and telling them they are liable for the actions of their agent. They are in breach of the Equality Act 2010 if they fail to make a reasonable adjustment for you. Tell the landowners how this is making you feel and ask that it is cancelled.

    Same goes for if there is a retailer on site. Show them the reply you have had and tell them how you feel.

    Same goes for your MP and Mrs May/Mr Corbyn, send them a letter showing them the fine and tell them what you told us, in your own words. Ask why the Government is allowing this attack on motorists which is every bit as bad as clamping cars used to be.

    Reply on this thread if you are worried. We can help at all stages. Maybe even an IAS appeal showing your disability proof...although the IAS is a 'kangaroo court' we do NOT normally try. We normally ignore the letters after a rejection letter from an IPC firm as the IAS is so bad.

    I can only imagine how awful this must be for you, but I can only echo what C-M has said:

    There is really, genuinely, nothing to worry about. The very last, very final, nuclear option they have is to take you to small claims court, where *IF* (and it's a big *IF*) they manage to win out in this case, you'll not be required to pay any more than they're asking for now. That's absolute utter worst case.

    Much more likely - were they to take it to court - would be that the judge would immediately chuck it out for them being unreasonable, and would slap them with the Equalities Act in the process.

    I realise that you're getting stressed out about this and it's worrying you - it's understandable to those people who haven't been through the rigmarole with these scumbag companies before.

    I'm 100% sure that - given your circumstances and feelings - people on this forum will be more than happy to walk you through this process and help you sort this out in far more depth than would normally be the case.

    Just don't let it get to you (easier said than done I know), and just keep writing about what you've tried and done on this thread, and people will help you with the next step.

    Seriously - you'll not be paying them a penny.

    Hello...

    Thank you for the quick replies, I am so very grateful and reassured. I've seen my GP and he has up'd my dose of Propanol for the anxiety and my Promethazine to calm me down. I'm so grateful.

    I will look into that land owner recommendation, at the very least it will give me something to do, in a weird way to take my mind off. I will sit and wait and update as and when I hear. I will also look into the appeal with the other company and see what happens.

    I have been trying to engage with my MP on this issue, and earlier today I had an emailed response from her in which she outlined that she shared my concerns and was looking to raise the issue with Sajid Javid, who is the appropriate Secretary of State.

    After having written to her initially, and subsequently happening across both your and several other cases in the past week or so where the behaviour of the PPC has been manifestly unfair and, in your case and others illegal under the Equalities Act. I have written back to her today and pointed her in the direction of this thread and your case as an example of the kind of stress and harm receipt of one of these "charges" can potentially cause. To many people, receiving one of these notices is simply an annoyance. For people such as you, receiving one could easily be excessively harmful, especially considering the moral vacuum these companies operate in which prevents them from simply cancelling the ticket once you appeal.

    I hope that you do not mind that I have brought this case to her attention. Hopefully, it will bring you some peace to know that someone else is on "your side", as are most of the posters on this forum, and certainly those on this thread.

    (On a related not, if you've still got the hard copy of the ticket that was on display, then should Euro Parking Services have a brain-power failure and take you to court, then you'll be able to waltz in to see the judge with a smile on your face and a song in your heart knowing that as soon as he/she sees the correct fee displayed on a ticket with the right date, they'll slap the PPC so hard they won't know what day of the week it is.)

    Scott, Catharsis is one of the good guys on here and has done some splendid work towards highlighting the problems motorists are finding at the hands of private parking companies. You can be assured that pointing an MP towards your case is a good thing.

    Everyone here is on your side, and they all volunteer to help in any way they can.

    You are amongst friends. You have appealed so now you should concentrate on getting well whilst you wait to see what happens.

    Someone will be here to help you when you need it.
