Completion date funds transfer failure

I live in scotland and had a completion date of last friday (14/9/07). the funds have not came throught. my sol said that the buyers sol hasnt sent throught their cheque for the sale and are therefore in breach of contract. there is no concrete date or time of when i am to receive the funds from the sale and am getting really teed off with it.
I thought that the missives wouldnt have been signed unless the mortgage funds had been secured from the buyer and my sol would have chased up this a couple of weeks in advance and certainly to have made sure that the cheque was received the day before completion, but i have been told this is not the case in scotish property law.
can someone please shed light on if this is true or not and any advice on how to proceed???
