Mortgage and prison

Apologies if this is the wrong place to put my question, my head is all over the place..My brother has just been sentenced to 3yrs in prison allegations regarding an ex girlfriend, totally not true, we are appealing the case.
I've spent 3 weeks sorting his finances out..money is running out and I'm paying his credit cards etc.. He has a mortgage and a son that wants to rent his house, the mortgage company have said they will look into a 'consent to rent'? But his son is claiming housing benefit, how can I tackle this situation please. My own family is suffering because of this, but he's my brother, I have to help in any way I can. Thank you for any advice .

    Does the mortgage company know that the proposed tenant is a member of the family? This can often be a relevant consideration in whether they will grant consent to let.


    The other issue may be with the local council. There are rules about 'contrived tenancies' where the council won't pay housing benefit, and in some circumstances they will deem it a contrived tenancy when a property is let to a family member. I'm not fully up with the details, but hopefully others will be able to help more.

    Unless you are willing/able to continue to pay your brothers credit cards for the next 18 months or so I would suggest you cease doing so. I apprecaite you say he is appealing the sentence.

    The renting of the mortgaged property to your brothers son sounds like a non starter, sorry.
