HELP - 02 is stopping me getting a mortgage and ruining my credit file!

Hey everyone,

Some of you may remember 02 online being featured on BBC1 watchdog programme a few years back for putting default notices onto people’s credit files with no reason or paperwork. Many reported cases happened with some poor !!!!!!s having a default left without their knowledge for as little as £8.

I was disgusted with their service from a 12 month contract I took out in 2004. I could not wait for it end and they owed me around £55 from overcharging as the contract neared its end. This figure was the same as the last bill I received from them and after calling them I was reassured this was going to be refunded and would come off my last bill thus paying nothing. I was told this in Feb 2005 and that was the last of it... or so I thought....

After doing a check with Experian I discovered to my horror this default from early 2005. I was never sent any letters or a default notice of any kind. I then realized I had no hope of getting the mortgage I wanted to go for at the time. I called them and eventually was told that a company called insights based in Leeds was who I needed to contact.

The girl was very helpful and went through everything with me saying that a default of £26 was caused because the refund was less than I was told and there was remaining money owed. I was still confused because this default was settled and I don't see how it could be if I never knew or made a payment after its issue.

So there I am racking my brain as what to do next... Solicitor??

What I did find was a helpful site on the net which gave me a template letter that allowed me to copy/paste and then adapt which was sent recorded along with a postal order to the insights address at Leeds.

The letter was professional and asked them to supply a copy of the default notice to me under the consumer credit act 1974 legislation.

They replied with a snotty letter saying that the consumer credit act of 1974 does not apply to a mobile phone monthly contract. They even said that the it wasn't satisfied when on my Experian credit file it does!

This is a ridiculous situation I now find myself in. I will be refused a mortgage 100% and this is my only bad mark. Why should I be put into the sub-prime cat because of a useless mobile phone company that thinks it can do as it likes.

I really need some help with what to do next and I won't stand for this.

Please help someone.

  • As far as I know you can put a 100 word 'statement' on your credit file, you could explain and refer to the Watchdog episode? Might help?

    Also write them an official letter of complaint, if they dont do anything within 8 weeks you can ask the Financial Ombudsman Service to investigate.
