Won case against next directory, but Lowell are taking me to court

Hello, 5 years ago Next took me to court over a debt and I won. Since then however I have been constantly harassed by multiple solicitors acting on behalf of Next. Today I received a letter from Lowell, which was a claim form to complete. I don't know what to do. I thought this was over. I know I have to acknowledge that form otherwise they could take me to court if I ignore it ( I was told), but I am not sure.

    When you say, you won, what was the outcome ?

    And why then are they still pursuing the same debt ?

    If you have received a claim form YOU MUST acknowledge service online ASAP this gives you 28 days to file your defence.

    Your post poses more questions than answers to be honest.

  • The judge said they had no claim against me because they couldn't produce a signed by me cca. The never removed the default they had put on my credit file, I don't know if that is why they are doing this again.

    Ok, debts get passed around like car keys at a swingers party, Lowell are probebley not aware of previous action on this debt.

    What you need to do is defend the claim in full, because no credit agreement exists for the account they say you owe.

    Ask on legal beagles as to how you should word this, due to the previous court action.

    Try not to worry about it, you have a good case here, as I said, Lowell are most likley unaware of activities prior to them becoming involved.

    acknowledge service (online)

    Then defend online - no compliant agreement, unenforceable under s127(3) cca, already been defended successfully under (court reference if you can find it).
