    As far as I can work out, IDEM being not very helpful, there was a debt consolidation loan taken out with 'Picture Finance' which was secured against the house. This was back in 2006. My Sister and Husband are not being helpful in how this debt was accumulated, I suspect credit cards, but I have contacted IDEM to name the creditors, which so far they have not replied to.

    You say they were evicted, Do you know if a court claim has been made for the 90k debt ?

  • I'm requesting copies of all communications. It looks like most of the originals were lost in the move.
  • I am going to ask a question here and I do not wish to seem rude, but is it obvious that your sister and brother-in-law are borderline learning disabled?
    I am asking, as I am thinking that for future info you might consider having some of the debt disputed because..."you [or in this case your sister and brother-in-law] didn't understand what you[ they] were doing when you [they]signed the agreement because you [they] have a learning disability or mental illness."

    Vulnerable people should not be exploited. I am not saying it did happen, but you never know.

    Another step you can take, if no legal action has been taken on the 90k debt, then a CCA request should be made ASAP.

    Are you aware of what a CCA request is ?

    If the original creditor went bust, it's unlikely any paperwork exists.

    Also you can contact the FSCS for PPI complaints against Picture. You won't get as much as you would if they were trading, but you would get 90% back - Single Premium would be the complaint reason.

    Idem is the new name for Paragon, who (pre-2008) would give out high-interest SECURED loans to homeowners with a poor credit history. Usually sold on the basis of 'wrap up all your debts in one neat package'

    It was the sort of thing Carol Vorderman used to promote, with a different company, and in my early days on this site we got together a petition against her with a million signatures IIRC.

    Anyway, I suspect Idem got a 28-day possession order with a warrant of eviction to follow. If I'm right, it's legal. They will now sell the house to pay off themselves and any one else with security in the property. Any money left over goes back to the owners. Any debt left over becomes unsecured.

    Your sister and husband really have a housing issue now, not a debt problem.
  • I've managed to get the reports from Experian and Equifax but Noddle couldn't verify either of their identities for some reason. I'm currently going through and trying to get a handle on the problem.

    Again, thanks for all the advice.
  • Regarding the learning difficulties, there is nothing official. I'm not sure they have ever been tested. I'm only going on the opinion of my partner who is a medical doctor.

    I'll certainly be looking into it.
