Adding myself to partners mortage after her divorce

Hi,
Advice needed please. My partner has recently been divorced and has just completed the transfer of equity for her house from her ex husband into her sole name on the land registry. The ex is still on the mortgage due to the lender not releasing him and her wages being too low to manage on her own. I have moved in with her and want to be added to the mortgage to remove him and of course added to the deeds. Can this be done simply by remortgaging to another lender and my partner and I applying together? or are we restricted with approaching the existing lender for me to replace him, and then looking to remortgage once I am on the deeds? she is now on the lenders SVR so would be beneficial to move lenders?

You can look for a new lender or see if the existing lender will offer you and your partner a New deal in your names0
