Restons fee to discharge charging order?

Hello. I hope I'm not duplicating another thread here but I can't see anything similar

I have recently, after 5 difficult years, paid off my £24k DMP which included a debt originating from MBNA on which Restons obtained a CCJ and final charging order against my property.

I received a call from Restons today (2weeks after my final payment to them) telling me that the balance is clear but I now need to pay 'just £120' to have the Charging order discharged.

In no previous correspondence has this £120 been mentioned and it has come as an unpleasant surprise. Rather than pay the £120 I have asked them to confirm it in writing so I can seek some advice.

Can anyone offer any guidance on this?

After several unpleasant years of dealing with Restons I am well aware of their often unethical practices, so I don't want to pay them this money until I've confirmed it's legitimate. I'm happy to pay a fee if it's due but would prefer to deal directly with the court/land registry if this is an option.

Any advice will be gratefully received

  • I know nothing but Citizens advice says

    "If you pay off the amount you owe under the charging order, you can apply to the court for the order to be discharged. Ask the court for a certificate of satisfaction on your county court judgment and include evidence of payment.

    You can then use the certificate to get the Register of Judgments, Orders and Fines changed. This should make it easier for you to get credit.

    It is usual for creditors to inform the Land Registry that the interim and final charging order have been discharged."

    If you have paid off the charging order, i would ignore Restons for now, and apply directly to the court for the charging order to be discharged.

    There will be court fees and costs to pay, so there calculation may be correct.

    Ask the court for a certificate of satisfaction on your CCJ, and include some evidence of payment.

    Creditors will usually inform Land Registry that the debt has been paid, so the charging order can be removed from your property.
