So what do you think guys? Am I right to think that as child benefit is not counted that that would wipe out the money left over each month? If our SOA is accepted the way it is?
So bit of background , OH and myself, OH is the one going br, two teenage children both at college, claiming EMA. Vast(well not vast really lol, but more than av I guess) range of animals to feed also.

We still have the use of sky at the moment, should we change to freesat as reading the OR guidelines this in not an allowed expense. We are not held by contract on this so it wouldnt be a matter for the OR. However our BB internet with BT, is subject to contract as we change this around the begining of the new year(this is who we have our landline with). Although, my 2 teens need it despartely for their studies, especially as my son is doing a media course, is there any way of getting the OR to leave this?

And one last thing, the tenancy for our house is in my name not OH's, always has been, is there going to be a problem getting the OR to allow for rent arrears and benefit overpayment? As these are in my name also.......

Thanks in advance for taking time to look and for any advice? :T

My child benefit should also be increased as I am able to claim inrespect of my 18yr old, but I havent had anything back from the CBoffice yet.

  • Hi SW, soooooo many questions !!

Well lets see... I am a bit confused at a couple of things, rent arrears and catologue debts would have to go in to the bankruptcy, so there would be no allowance for them. ( I assume your both going BR ?? )

I would put the clothing up to £80 and would include a holiday fund of £ 60 - not sure if ive sent you in to negative there ??

Make sure it balances but CTC or CB should not go in to the calculation. You should never get an IPA.

Also your benefit overpayment will be written off at discharge, although payments will continue till then ( unless the law changes, as this is being challenged by gov. departments.

    Good luck !

  • Hi Debt Doctor,
Its just my OH that is going BR, the rent arrears are in my name, as its my name on the tenancy. Housing tax/and council tax benefit where claimed in my name also, the overpayment comes as there was a mistake with our tax credits) It all happened at the begining of the year whilst my OH was changing jobs, after being made redundant. The catalogue is also in my name. So they cannot be included in my OH's BR.........I have an agreement with the council to pay back instalments the arrears and benefit overpayment, and an arrangement with the catalogue too.....we are having money taken out of the tax credits for an over payment there also, again claimed in my name lol............confused? me too:rolleyes:............god, I will be so glad when we just get this done, I am totally worn out be all this!

So I guess the OR is going to have issues about this:confused:

Thanks again DD, I appreciate your input:T

    Hi scaredwitless,

You're over complicating things here, and for the court papers you don't need to have things 100% accurate; an approximation of your income & expenditure is all they're looking for.

Don't bother yourself with the minutiae, the O.R will help your O.H get it as accuarte as it needs to be. If it's your O.H going bankrupt then it's only his income and contribution to essential expenditure that should be included on the forms.

His wage should be figure for income and then estimate your expenditure as accurately as you can without complicating things. There's four of you with an income of £1,429 less child benefit, so there's no chance of an IPA.

    Hope that helps,

    Richard

EDIT: Don't worry about a budget that shows your expenditure more than your income; your response to that is you're desperately cutting costs where you can.
  • Hi Richard,
Thanks for the reassure and yes your post does actually help very much, I do see what you mean about over complicating things. Time to put these forms away for the night, and have a break! Will finish them in the morning and phone for a court date on monday :)
    Cheers!

    Hi sw,

That is what I was hoping you'd do. The Court / Judge will hardly give them a second glance and any errors the O.R will put right. It's a difficult thing to do without making it any harder.

Enjoy the rest of the weekend; it'll work out just fine.

  • Yep I echo Richards thoughts on the whole thing. Thanks for clearing my confusion about the arrears etc, As Richard indicated its not you who is coming under scrutiny, your not BR!

    Good luck with everything,
