I have one. There's a section 'Partners declaration' that states " If you have declared your partners income details as part of your overall income when you applied for this loan, your partner will need to sign below confirming agreement for their information to be used in considering the loan and its repayment" . I thought this would have been enough to place some of the liability on him but apparently not!0

As I said it's not about liability to the bank it's about a civil liability to what you and your ex agreed to at the time it was taken out. So if he agreed to share the debt then this is a civil liability to you.
The courts see it all the time, you aren't the first to take out a loan for a joint debt only for the partner to run away and you won't be the last.0 -
After speaking to a solicitor (via a call on my works employee wellness scheme) he said there wasn't much point going to small claims as I was unlikely to win however your post has made me have a rethink. I'll take my paperwork to the CAB and see if they think it's worth pursuing. Thanks for posting:)0
