Confused by payments

My ex earns £580 per week and has 3 children that live with him and his wife 2 are his and 1 is not.
According to the csa calculator he should pay me £58 per week in maintenance for our 1 child together taking into account his 3 other dependants.
Got my calculation through and it says as he has 3 other children he has to pay me £27 per week.
Surely this isn't right!!!
Don't get me wrong I am grateful for the money as I know some people get nothing but I expected it to be at least a bit closer to £58 as he earns quite a bit!
Thanks guys

  • Does he maybe pay into a pension that brings down his pay?

Do you know how much he puts into a pension? Pension contributions are removed from the salary before they calculate the reduction for the 3 children that live with him and then calculate your amount.

Is he paying maintenance to anyone else, as that would also affect the calculation?

He will probably be doing everything he can to make his income on paper seem lower than it is, so may up his pension contribution, drop hours or buy extra holiday etc to avoid paying the extra in maintenance (going from what I've read in your other posts.)

Having a play around with the calculator, could he be claiming to have split with his wife, as you'd get closer to that amount if he was 'single' and paying CM to the wife for the 2 kids that are his, and to you for the 1 child. As his wife has been telling you you're not getting a penny, seems like a scheme she might entertain.
  • It says he has 3 other children which he pays for via a 'family based arrangement' and that they have taken this into account before working out how much to pay me.
I guess you are right kim

Defo not pension as that comes under the variations section and it says there are none. He defo lives with her, my friend lives opposite them and sees him all the time with her holding hands/ kissing etc and his car is always there- plus his tax address is there as that's where CMS wrote to him

Calculator comes out at £27.50 to you if he was assessed to pay for 4 children that he doesn't live with and has minimal/no care of. He's potentially lied to the CMS that he is the biological father of his step child also, in order to save £10 ish a week. His total assessment as a 'single' person is £110 so you'd get £36 something if he only paid for his biological children.

I say potentially lied as although the CMS can't enforce child maintenance for a step child, I'm unsure as to whether they would give him a reduction if they knew he was choosing to support a step child in a private arrangement (even if he was genuinely single.) If he has adopted the step child though, the CMS would definitely include him/her.

All secondary if he is pretending to be single though!
  • He is defo living there, what he is doing is saying he doesn't to reduce his maintenance payments. Well I don't know why I expected any less from such a liar!

Hopefully the CMS will throw the book at him.

At least you know how much you can expect if the wife wakes up and throws him out for good.

They own other houses it wouldn't be hard for him to claim to live at one address and her another- basically I think I'll have to accept that he won't get found out. They are just that sort of people that get away with it- false insurance claims and the lot- they got a whole new living room a few years ago as he tipped paint over his sofa etc and claimed on insurance it was an accident.
Some people just seem to get away with anything and others struggle.
I hope she does leave his sorry !!!!
He doesn't deserve my boy anyway, my beautiful son is worth a thousand of them.
