Going back in the Lions den

Hi Guys, I've only just joined this so not sure how it all works. Basically I can't find the answer to this question anywhere on the internet.

I went Bankrupt 7 years ago, so it doesn't show up on my records. That's all good.
However, I'd like to get a credit card again. Not because I want to go down the same road as before, but to be smart about it. I want one purely to gain air miles. I want to spend within my limits, pay off in full every month and gain some miles along the way.

Now the cards that offer these type of rewards, may have got caught up in my bankruptcy. It's so long ago now, I can't remember who got paid off and who got told I was bankrupt and didn't get a penny. Lets say, I apply for a card owned by MBNA, and MBNA didn't get all their money back from me. Would they have a record of that? would they try and sue me now they think I can afford it?

Any help will do, Many Thanks

  • Hiya,
They can't sue you, as you put it, if the debt was from before your bankruptcy, as all debts prior to that, even if they were not included in your bankruptcy, are now written off, unless they are in any of these catagories..
You’ll be freed from your debts once your bankruptcy has ended, except for:
    • debts gained by fraud
    • money owed under family proceedings (maintenance and lump sum settlements)
    • damages payable to anyone for personal injuries
    • student loans
    • court fines
    • debts created after the bankruptcy order.
    • As to whether they will let you have a credit card again that lets you get airmiles, somebody will be along who can answer that one!

    Hi Matr

Muttipops's answer looks very comprehensive to me. The debt itself is gone, kaput, wiped, whether you listed it in the bankruptcy at the time or not.

As for whether it will affect an application for a new MBNA card today, I can't see that being the case. They'll be relying chiefly on the information provided in your application form alongside whatever they find on your credit report - which will only cover the past six years. It's very unlikely that they will have retained details about your previous dealings with them until now, and less likely still that this info would have any bearing on a new assessment of your creditworthiness.
