Breaching a COT3 Agreement - what can happen

Need some advice please

what can/will happen if I breach the COT3 agreement

Will it just mean paying back the compensation I was paid

And how will this happen

    It entirely depends on what you do! Perhaps the more sensible thing would be to not breach it?
  • A COT3 is a contract. If you breach it, the employer could potentially try to recover the compensation, sue you for damages through the courts or (in some cases) seek an injunction.

    What kind of breach are we talking about here?

    Going public about the shambolic way I have been treated

    Why should I have to keep quiet when they admitted wrongful dismissal and in the process made an utter mess of the whole case

    Further more and more annoying a former colleague told a complete pack of lies (one of which even you or any one on here could disprove) besides this he then made a statement about me again totally untrue, so much so I say the opposite in my minutes and to make matters worse he was then promoted

    You should keep quiet because you agreed a payoff and a reference (I presume) to do so.

    Why sign it if you didn't want to?

    You should keep quiet because you agreed a payoff and a reference (I presume) to do so.

    Why sign it if you didn't want to?


    Believe or not I did not want the compo I wanted my job back

    They settled to avoid the negative press that would of followed hence the COT3

    They refused point blank to reinstate even though there was a vacancy for my position at the time

    But you clearly wanted it enough to sign it, if not and if you felt strongly enough you should have taken it to a tribunal.

    It did go to a tribunal though and they accepted liability for wrongful dismissal and refused ti reinstate

    So they settled before the final judgement?

    Why did you accept this, ultimately you accepted the agreement and you should adhere to this. There is the risk you will get sued in return for breaking this and will it gain you much bar a few seconds of glee that really most people in this country won't care about?

    Move on would be my advice

    Not sure, I'd expect costs would come into it somewhere as well but better people would advise on that.

    Your choice was to let it run its course at a tribunal if you wanted people to hear about it and the money didn't matter.
