Lowell - T-Mobile - Second Letter Does NOT Deliver What I Asked?!

Hello Everyone :)

I received a letter on the 20th Aug from Lowell stating that a debt of £275.92 had been sold to them by t mobile from a contract I had with them 5 years ago. I had also received a letter from "EE - once t mobile" stating the exact same thing and that the account was sold to Lowell.

First let me say this was the first time i had received any notice of any debt from them or otherwise. this account was settled as far as i was concerned and terminated due to products not being delivered and gross overcharging which we settled through their complaints system. so for me, the issue was over and done.

I then contacted t mobile (now EE) to which I was told over the phone that the fees incurred were from an early terminated (which I did not agree to) as these fees were given in the final month i paid to them (yes it was a lot lol) anyways as I further discussed with the representative about the account he then told me that ...

A) Lowell did not own the account at that time because t mobile had NOT sold it to them or had any knowledge of that. Also is must be noted that the EE rep at this point said "on your account with us it is written here it was WRITTEN OFF.
B) The "letter" from EE was actually in fact printed by lowell at the same office from the same printer in the same batch as my Lowell letter. This letter they had created themselves obviously in order to solidify their legitimacy ...

Anyways long story short ... i sent them a recorded delivery letter asking them for my ink signed contract to prove this debt ... to which i have received a letter with a break down they have wrote with no further evidence ...

at this point what would be my next course of action?

  • Write back stating they appear to have used a false instrument as in a forged letter claiming to be from EE which is nothing of the sort.

    Issue EE with a Subject Access Request and a cheque for £10 with "payment for subject access request written on the back.
    I do Contracts, all day every day.

    There will be no signed agreement for a mobile contract, use of the phone is concidered acceptance of the contract.

    If you have evidence that T mobile wrote off the debt, then send a copy to Lowell telling them that's your position, and you stand by it.

    That puts the ball firmly in there court.

    What you have described with the letters is common practice amongst DCA's.

    Written off on EE and T-Mobile's system does not mean they don't want the money back, just that it has been sold to a debt collection agency.

    You need to get written confirmation from EE that they considered the matter closed and the account balance nil at the time of you leaving them. Once you have this, you can tell Lowell to stick it.

    It sounds to me though that EE have not cleared the balance as you thought they would and that the account has been passed to Lowell after their internal debt collection procedures were exhausted.
