Capquest

Options
Hi

Hope someone will be able to advise, back in 2011 Capquest issed a statatory demand (I think thats what it was it definitely wasn't a CCJ) regarding a Natwest account that was not mine.

Long story short I turned up in court they did not and I was awarded £120 in costs, the demand was set aside and the cheque arrived about a month later.

Fast forward to today and Capquest have sent me 3 letters all sent on the same day all the same regarding this Natwest account.

Can someone please advise what I can do from here - they have been to court once and lost why are they still pursuing me?

Thanks

    Hi Alfie

Strange as it may sound, setting aside the statutory demand as you did in 2011 wouldn't have definitively quashed the "debt". It simply prevented Capquest from going any further with any potential attempts to make you bankrupt.

Having had their demand set aside, you would have been forgiven for thinking that they would drop the matter and amend their records to ensure they no longer pursued the wrong person. It seems that that has not happened - chances are that this is down to incompetence rather than a deliberate ploy to sit on the debt for five years before chasing you again, but that is beside the point.

I would suggest that you send them a copy of our "I do not owe the debt" letter:

    https://www.nationaldebtline.org/EW/sampleletters/Pages/Complaining-to-debt-collection-agencies-that-you-do-not-owe-the-debt-%28sole-name%29.aspx

All the guidance you need to quote is in there. If you still have any paperwork referring to the 2011 case, enclose a copy and ask Capquest if they wish to incur yet more costs this time round.

    Good luck
