Poundstopocket and Steapchange

Good afternoon everyone,

I have recently entered a DMP with Stepchange and one of the creditors is Poundstopocket. I have received an email from them today asking for for full repayment of my loan which is £1045. I am assuming they have rejected Stepchanges offer. Is this common practice during a DMP or should I be worried? I really don't want bailiffs at my door over this :sad:

    Don't worry. Respond to the email and advise them that you taken advice about your debts and StepChange debt charity are supporting you with a DMP. Note that StepChange will contact them with an affordable repayment offer, and that future payments to this account will be made directly through StepChange.

    Don't panic. They may not accept the DMP but nothing bad will happen. Keep them informed but just keep stating that you are moving to clear your debts through the support of SC and an affordable DMP.

    Pop over to the DMP Mutual Support thread - great people who have all either been through the DMP process - or like me are still going through it.:beer:

    I can’t comment on how Poundstopocket usually respond to DMP proposals but I just wanted to clarify that they can’t suddenly send bailiffs to your home.

    Potentially they could use a debt collection agency, who don’t have any more powers than the original lender. If you were contacted by debt collectors you would refer them to Stepchange to negotiate.

    In theory Poundstopocket could also make a claim in the county court. That would normally be done through the post or online and the court can set instalments based on how much you can afford. It's likely the instalments would be similar to what they're receiving through your DMP anyway so they may not think it's worth going through court.

    Enforcement such as bailiffs could only be used if you got a court judgement and defaulted on the payments.

    It's also likley that news of your DMP has not yet filtered through to Poundstopocket, so the email you received was probebly a computer generated affair, much like the debt collection letters they also send.

    Please try and do a little research for yourself on the law of the land, and debt collection processes in particular, normally bayliffs are not used to collect consumer credit act debts, if, they were to be used, the creditor must obtain judgement against you in court first, you must then default on the courts payments, only then would the option of a bailif be concidered.

    In practice an attachment of earnings order is more likley.

    As you are paying your DMP non of these senario's is likley to happen, if the creditor dosent like what you've offered in payment, they simply sell the debt on, they don't want the hassle or have the time, to take you to court, they just wash there hands of the account, and let someone else chase you for it.
