Requested info from alledged debt

Options
Hi,

Quick question,

I had hundreds of missed calls when I returned home from Holiday last week from a company called "OPOS LIMITED".

I wrote them a letter and sent it via Royal mail Signed,

pretty much saying I do not know what this debt is about and if they can provide proof of this debt asap.

They replied saying this..

" Good Morning

Thank you for your letter.

I can confirm that Opos Limited is a specialist and accredited debt collections company and that we have been referred this account by our client Safteynet Credit.

I can confirm that Opos Limited has not added any interest or charges to this balance in any capacity.

In terms of proof of debt this is not something we have been supplied. This is something that you would need to do yourself.

I can confirm however that this relates to a lzoan which was taken out on 28th July 2015 for the principal sum of £110.20. I can also confirm that the most recent repayment was made on 6th November 2015, within the last 12 months. This was made prior to Opos Limited managing the account. Therefore, it would appear you have acknowledged this debt within the last 12 months and are liable to paying us the sum owed immediately.

This is a matter of urgency and failure to pay within 14 days will give us no choice but to proceed with door step collection activity and possibly legal action.

Thank you "

I have basic knowledge on this kind of stuff and have been reading on the forums of things to do in situations like this and to never speak to them on the phone.

I answered a phone call a couple days ago from them and demanded they take my number off their list and only contact me via letter and the person on the other end said "No we will not be doing that. Your legally obliged to pay this debt today or we will send people to your house to take your belongings to pay off the debt and add large fees to the original debt"

I told him that I sent a letter asking for proof of this debt and he said "We don't do that, you owe the client money and that has been proven by a payment you made a couple months ago to them"

so I said "But that's not acknowledging the debt to you, thats to the previous client. It's been passed on to you and I know nothing of it so I require proof of this debt"

He hung up the phone.

Any help please?

Thanks

So you've sent a prove-it and they haven't proved it (in any meaningful way)

I'd be tempted to confirm back to them in writing their quotes
Your legally obliged to pay this debt today or we will send people to your house to take your belongings to pay off the debt and add large fees to the original debt

    also
In terms of proof of debt .... This is something that you would need to do yourself.

as part of a second letter from post#3 of this thread.

You will see that they are acting against FCA rules/guidance in half a dozen areas.

    Hi OP,

It was only last year, is it your debt ? or a complete mis-trace ?

The contents of there letter, and the phone call were complete and utter rubbish, Fatbellys advice above is good.

They can't take any of your belongings, and neither can anyone else, until it's been to court, and the court had found against you.

While I agree with all the advice above, did you make a payment a few months ago to the previous client?

If so I am sure that will count as an acknowledgment. If they are just saying that with the intention of saying you admitted it over the phone that will be different.
