Is the Waiver a separate document or part of his contract of employment document? (It's not clear to me from the wording in the OP). In other words ... is he able to separately sign to accept the contract of employment but not sign the waiver?

Its not uncommon to sign these waivers, if there is any chance that employees might work more than 48 hours a week.

The employer probably asks the waivers to be signed by everyone so that they don't have to bother tracking staff hours to make sure that noone is working more than 48 hours a week.
