Hi All
I have been on my DMP now for a year with CCCS (thanks to you all!!!) . I haven't had any problems and infact have been able to increase payments by 12% after my annual review last month thanks to a change in my contract:j
BUT over the last two weeks i have been bombarded by letters and phone calls by MBNA the final straw was today when i had a message on my home phone, mobile AND work phone saying that i MUST call as soon as i recieve the message, that time is not on my side (I QUOTE!!) and that they need to discuss options with me ,, i then also got a text saying I MUST CALL
i am really unsettled by this i feel like despite my huge effort i feel like i have gone back to square one,, am i just over reacting?,, are MBNA just being bullies as per usual or do they usually do this and take further action after a certain amount of time - Has any DFWer had any experience of this
i wrote to them today to give them my CCCS ref number and asked them to contact CCCS directly
your thoughts would be very much appreciated

I started to reclaim charges from MBNA on behalf of my hubby in May. He filled out an application for their card several years ago. The process of getting the charges refunded has taken approximately 3 months. The amount was 280 short of the outstanding balance. They constantly sent threatening letters, some i ignored and some i responded to. After a particularly stern response from me they refunded the amount i had requested plus all the interest and charges they'd applied since i 1st put in the claim.
By ignoring CCCS they are not following OFT guidelines. Because you are also maintaining payments their behaviour would be frowned upon.
I would right to inform them of this. If you can, look for the OFT debt collection guidance and quote from that.
If they continue to hassle you, write and request their official complaints procedure.
If they continue after this - report them!!
Have a look at the Consumer Advice Group website. There's an MBNA forum which will make interesting reading. I have thread on there now marked WON!
Don't let them bully you. I would avoid discussing anything on the 'phone, keep it all in writing. Feel free to send me a message if you need any more info.

thanks so much for your reply hopeful1,,, you have made me feel much better .....you are right they are just bullies - it just made me feel so low today after a full year of accepting my debts and doing my best to sort them out that they are behaving like this - Its not like i am ignoring them , i am paying them back!

Are there any charges on the account that you could reclaim? I'm assuming this is a credit card, so correct me if i'm wrong. I asked MBNA to send me a copy of the original credit agreement which they didn't. They sent the original application form. Once my hubby has paid the outstanding 280.00 i will be writing to reclaim the PPI they deducted for about 5 years on the basis that they have no contract to show what he agreed to. I know some people that are using this as a basis to reclaim interest. It appears unusual for MBNA to have contracts for older accounts.
Hope you enjoy that Kipling slice
