Notice of transfer of proceedings

I received a CCJ in 2009 from Bryan Carter & Co and was instructed by Northampton County Court to pay it off at £10 per month re account Egg. This I have done on time every month since.

I have now received a notice that says Notice of Transfer of Proceedings and very little else.
It says 1st Claimant Arrow Global Guernsey ref Egg and 1st Defendant me

The only other wording is County Court Business Centre and in the body of the letter

To all parties

This claim has been transferred to the County Court (and then the name of my local Courthouse) as the CCBC Sol is no longer acting

There are no instructions and no further information. Can anyone tell me what this document means and what I can do.

It looks to me as though Global Guernsey have taken over the CCJ without anyone telling me on an unspecified date and Bryan Carter are continuing to accept payment without telling them.

All very worrying as I don't understand whats going on. I have asked for copies of my credit files to see if anything is reflected on there.

Any help or advice would be appreciated

does it have a claim reference number on it? if so ring the court and find out if it is indeed genuine

eta- it looks like they may be going for an attachment of earnings/redetermination of the amount you are paying each month..

Yes it has a claim reference and I will contact the court.

The thing is I don't know who Arrow Global are and am still paying Bryan Carter. Never missed a payment in over 7 years.
Can they still take action against me. Have dread of Bailiffs coming and also that they have after all this time transferred my account

Has anyone else had a notice of transfer of proceedings and what was the outcome

    Many thanks

    Hi

I agree that contacting the court is the best plan to find out more information.

The debt can be sold on to another company but any payments you’ve made should be coming off the total balance. Request statements of the account to make sure the money you’ve paid to Bryan Carter has been accounted for.

As long as you’ve never missed a payment that the court set on the instalment order no enforcement action such as attachment of earnings or bailiffs can be used. It’s possible that Arrow might be applying for an information order to get an update on your circumstances. They may then consider applying for a variation if they feel you should pay more per month but that’s ultimately up to the court.
