Inhibition Order (Illegal)

Hi all, got a letter today when I read it, it threatened me with an inhibition order, now the property I live in I do not own, have any financial ties to, or pay rent for. I'm just a nobody.

Is this illegal in Scotland to threaten someone else property, as well as me????

Comments

  • Can someone give some advice as what to do, from what I have read that in Scotland this is classed as a criminal offence.

Anyone got any extra info to help me

Are you in line to inherit any property or land?
  • No I'm into inheriting any property from anyone. Know this for a fact, and it's from Student Loans over a Payment. Checked up on the law, comes under Miscommunication Act 1988.

Says that they can't send a letter with threats cause me distress or anxiety so that I pay.

You're a squatter then? is the inhibition order to get you to move on from this property that you dont own, have any financial ties too, or pay rents for, or is it for something else?

If you owe money then companies can chase you for money but that said that doesnt mean you are required to pay.

What did this letter say? does it relate to a debt you are aware off?

    Need more information.

  • No I live with my partner. I have nothing to do with the house, it's her home. I pay no bills.

It's for an overpayment for student loans. Which I ain't paying

If you want helpful advice it is better that you give the relevant information in your opening post, rather than wait for it to be teased out of you.

It appears that student loans think they gave you too high a loan. Now that you have said you live with your partner, I'm assuming that it is because you didn't give this information to them originally ie they based the loan calculation on you having no support rather than living together partner income? Or was it that you declared your support as being unmarried partner rather than parental income?

Either way you need to address why they think they overpaid you.

If you can't prove that they didn't over pay you then you owe the money back, so you need to agree a repayment schedule with them. Student loan payments never go away, even in bankruptcy, so better to deal with it.
