Query on child support payments

Hi everyone,

My boyfriend has a 4year old from a previous relationship and his mother has contacted CSA for child maintenance as she feels the private arrangement they have isn't working out. My partner hadn't been able to do overtime due to ongoing illness and had since struggled to find money for additional things she's asked for. Both parties have called the CSA to get the ball rolling. They have a case open from 2014 but have been sticking to a private arrangement. The previous arrangement was £37 per week via the CSA but this was when my parter was living with his parents and had more income to play with. The CSA basically said it looked like the previous arrangement would still be valid even though his income is slightly more and his outgoings are a lot more. His ex however, her situation had completely changed - she has another child whom she claims child benefit for as well, she's working full time and she's engaged and getting married very soon.
My question is, do her finances and circumstances get looked into as well regarding what she's entitled to or is it just my boyfriends? Essentially leading to money he doesn't have being taken

Any help and advice would be greatly appreciated

The child support calculations do not look at the parent with care's financial situation. They are based on the income of the non resident parent. They take into account any other children that live with the NRP but AFAIK that is the only adjustment.

He doesn't have to pay anything more than the amount set by the CSA.

The amount he pays can be reduced if he has the child overnight for more than a certain number of nights a year.
  • He's getting off pretty lightly with £37 per week. If they were still together I can guarantee he would be spending more than this on his child. If the Mother is working full time and the child is 4 this suggests considerable childcare costs too.
  • Your boyfriends legal contribution is a minimum of 15% of his income. This is the minimum and many non resident parents pay more. Why has the private arrangement broken down?

The income of the parent with care is irrelevant.
