NHS job offer withdrawn - is it sickness

    Of course you do!

    There are thousands of people in each NHS Trust. The chances of HR even knowing the name of an individual employee is minimal, let alone having an opinion on their employability.

    As an ex-NHS manager, HR definitely know who has been through the rougher end of the sickness policy (as certain individuals seems to keep going through it) at the 4 trusts I worked for. And information is only shared if a person applies for a position in another public sector role, as it would be for anyone regardless of sickness.

    If you keep getting sick, your name will be known. Not a blacklist as such, more a keep an eye on list.

    Not at all I think they are an overpaid group but you are the one accusing the WHOLE PUBLIC SECTOR of operating a blacklist (which is illegal). You have not even provided evidence that this happens in the NHS.

    While it probably happens in a few small private sector employers, large employers know that the penalties under the ERA99 and the DPA and the reputational damage make this a high risk strategy which could see individuals in prison. The public sector has no incentive to break the law and also has to abideby the Public Sector Equality Duty.
    Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.

    The O.P. has not only had a lot of time off sick but they mentioned a complaint involving their manager , so H.R. will certainly know who they are , and I believe the chances of an off the record tip to the new employer are high.
    O.P. - are there any agencies operating in your area that you could sign up with ? Either full time if the present situation is intolerable , or the occasional extra shift
    The reason I'm suggesting this is , firstly agencies don't care so much about your record as they're not guaranteeing you anything.Secondly , as someone already mentioned , your record might make it hard to get another NHS job. I think your chances will be increased if you get a few shifts somewhere and impress them enough to take a chance on you

  • I feel sorry for the OP. It sounds as though this person has had a really hard time with their manager and needs to get a job elsewhere to escape. They are now trapped and will have to return to work with this manager.

    I also have 20 years within the NHS and have seen, over the years, how a bully in a department can destroy an excellent employee. Totally unprofessional behaviour. It is a terrible situation when the bully (or, person causing the stress) is a manager! Three of my excellent ex-colleagues left because of a manager. There is a big difference between managing someone and bullying them.

    You could look at it from another perspective. The place you applied to is already suffering with staff going of sick due to stress because of the high level expectation placed on their team. Unfortunately, it seems to be becoming viral all around NHS Trusts. The candidate they were looking for not only needed the right skills, but also an exceptional level of resilience. Your sickness level is an indication that you might not have the level of resilience required, so it is a blessing for them, but also for you that they are not offering you the job.

    Sorry, but they may think you've under-declared your sickness. You may only work four days a week but you are still sick on the days you don't work. (You don't suddenly recover on Saturday and then fall ill again on Monday - it's continuous).


    Sickness absence is calculated in calendar days, not working days. ESR (NHS Electronic Staff Record) is an integrated HR and payroll system. When I left the HR part was not great but the payroll bit was better than any other payroll system I'd experienced in the NHS. The "over 100 days" you state is almost certainly correct (assuming your absence dates etc were correctly recorded).


    One of (but not the only) reason calendar days are important, is that that is how you are paid in the NHS. You get an annual salary, divided by 12 months, and then divided by the number of days in each calendar month. (So you get a higher "daily rate" in 28 day February than in 31 day December). This means you are in effect getting paid for the days in the month you don't work. So these days count as sickness absence even if you would not have worked them.


    Do you not have access to your own sickness record via ESR? This was meant to be a feature of it.
